Checking a letting agent's credentials
In England, letting agents must belong to a government approved redress scheme, either The Property Ombudsman or the Property Redress Scheme, and any agent holding client money should be a member of a Client Money Protection scheme. Many reputable agents are also members of professional bodies such as Propertymark (ARLA) or the RICS. Before instructing an agent, check they display their fees clearly, hold the correct memberships and protect tenant deposits in a government approved scheme such as the Deposit Protection Service, MyDeposits or the Tenancy Deposit Scheme.
Landlord and tenant responsibilities
Letting agents help landlords meet legal duties, including gas safety checks by a Gas Safe registered engineer, an Energy Performance Certificate, electrical installation condition reports and smoke and carbon monoxide alarm requirements. They also carry out right to rent immigration checks and referencing on prospective tenants. Ask whether a service is tenant find only or fully managed, and confirm what is included, as management fees, renewal charges and inventory costs vary between agents.
What is the difference between tenant find and fully managed services?
A tenant find service covers marketing, viewings, referencing and setting up the tenancy, after which the landlord manages the property directly. A fully managed service adds ongoing rent collection, inspections, maintenance coordination and handling of day to day issues throughout the tenancy, usually for a higher monthly fee.
Can letting agents charge tenants fees?
Under the Tenant Fees Act 2019, most fees charged to tenants in England are banned. Agents can only request permitted payments such as rent, a capped tenancy deposit, a capped holding deposit and certain default charges. If an agent asks for administration or referencing fees from a tenant, this is not usually permitted, and you can report concerns to the relevant redress scheme.
